It’s Unlawful to Grant Short Tenancy to Foreigners Without Working Permit – Rent Control Department

Mr. Emmanuel Hovey Kporsu, Public Relations Officer, Rent Control Department has indicated it is against the law for landlords to grant any form of tenancy (long or short) to foreigners who do not have working permit in Ghana to use such space. He disclosed this in an exclusive interview with Real Estate Times Africa adding that any tenancy agreement not more than six months is a short tenancy. Short tenancy according to him is usually with foreigners who come to the country on the bases of work or for a short visit.

“As a foreigner, in order to access short tenancy in Ghana, you should have a working permit without this its unlaw to access such an accommodation and you are also not permitted to stay in the country more than six months. Foreigners who come into the country and stay on short terms usually prefer furnished facilities. He also said that most landlord’s tries to take advantage of these foreigners by increasing their rents when they intend to renew it.  

He explained that according to the Rent Act 1963, Act 220, there are two types of tenancy in Ghana thus, short term tenancy and long-term tenancy. “If a tenancy agreement is signed between two people of which the agreement would not exceed six months, which is known as short tenancy, the law mandates that a monthly rent advance should be collected from the tenant until his or her period is due but when it comes to long term tenancy agreement, the maximum amount the law allows a landlord to collect is six months block rent advance.”

  He further added, any tenancy agreement you sign should be assured. An assured tenancy is a legal category of residential tenancy to an individual. A tenant under assured tenancy cannot be evicted without any reasonable ground. A tenancy contract can be terminated only when its expiring date is due.

He finally concluded that in any case where a consensus is not reached, the Rent Control Department is the better place to seek redress.
